1. Definitions

1. ‘Carrier’ means the delivery courier, carrier or transport company used by us to deliver the goods to our buyers.

2. ‘Contract’ means the contract between us (the seller) and you (the buyer) for the sale and purchase of goods which is incorporating these terms and conditions.

3. ‘Price’ means the VAT inclusive price which is stipulated for the items on our website at the time that you make an order to purchase the items.

4. ‘Made to order’ means items that have been made specifically to the buyer’s specification. You will be notified that these items are made to order prior to the contract being made.

5. ‘Terms and conditions’ means the terms and conditions of the sale set out in this agreement and any special terms and conditions agreed in writing by us.

6. ‘VAT’ means value added tax at the current UK rate in force at the time you make an order or pay for your order.

7. ‘Website’ means our website www.milk-interiors.co.uk

8. ‘We’ ‘Our’ ‘Us’ means Milk Interiors , which owns and operates the Milk Interiors website at www.milk-interiors.co.uk

9. ‘You’ ‘Your’ means the individual/organisation who buys or agrees to buy items from us.

2. Conditions

1. Nothing in these terms and conditions shall affect your statutory rights as a consumer.

2. These terms and conditions apply to all contracts for the sale of items by us to you and will prevail over any other documentation or communication made between you and us.

3. Acceptance of the delivery of the items will be deemed as conclusive evidence of your acceptance of these terms and conditions.

4. Any variation to these terms and conditions will be inapplicable unless agreed in writing between you and us.

3. Contract

We need to have received payment from you before we can place the order with our supplier. Once we have received payment we can then place the order and then confirm that your order has been placed by sending you an invoice through email. Once we accept your order a legally binding contract has been made between us.

4. Prices

The prices that are required to be paid for items are set out in our website. Where applicable, you will be required to pay for delivery charges. We always try to make sure that all prices on our website are accurate at the time you place your order. If there is an error in the price and the price that you order the product at is incorrect, we will offer you the chance the reconfirm your order at the correct price or we will allow you to cancel your order. All the products are subject to availability and so if you place an order and the product becomes discontinued we will inform you straight away and will give you the option of purchasing an alternative product or we will reduce the payment of your order by the value equal to the price of the unavailable product.

5. Payment

We always ask for payment in advance of your delivery. This can be done via PayPal on our website when placing your order or by phoning us and taking payment over the phone. Once payment has been received and we have placed your order with our supplier you will receive an email confirming your order and payment. All prices on our website are shown in pounds (GBP £) and are inclusive of UK VAT at 20%.

6. Delivery

For deliveries that are under £500 a £15 delivery fee will be charged. For orders that are over £500 delivery will be free. The items that you order will be delivered to the address that you give to us when you place your order. We aim to have orders dispatched out within 2 weeks of the order being accepted but please allow a little longer. During busier times or for our made to order products the timeframe could increase. For us a working day is any day excluding weekends, bank holidays or public holidays. If a delivery cannot be made to the address that you provide us with then we will inform you straight away. We will make every effort to ensure that your items are delivered as soon as possible. If a carrier is used, you will be asked to sign for the items. Only sign for them after you have checked them over to ensure that there are no damages.

7. Delays

At times there may be delays in production or shipping. If this occurs we will inform you straight away and then do everything we can to speed up the delays and get you items to you as soon as possible. In most of the cases, delays may occur during busy holiday seasons, due to production delays at the supplier’s factories or may be down to other factors that are not in our control. We cannot be held responsible for any product delays from our suppliers. Please note that the delivery times on our website are only approximate and can vary at times.

8. Returns

Made to order products cannot be returned at all. If you receive a product that is damaged you need to contact us straight away. We can then contact the suppliers and arrange for the item to be replaced or for the replacement part to be delivered as a replacement. Please only make an order if you are completely sure that item and its finishes are right for you as once the item has been entered into production with our supplier you won’t be able to make any changes to it. Also if the item is different to what you expected it to look like following delivery you won’t be able to return it due to it being a made to order item. The item can only be returned if we haven’t supplied the correct item or finish as per the order. Also please ensure that you check the access to your property as we deliver on the basis that you’ve check all dimensions of the items and that it will fit through all doorways and within the area that you will be placing the item. Before returning an item or exchanging it for a different item you must contact us within 7 days and we can check if the item can be returned.

9. Products

We make every effort to ensure that that product colours appear on the website as realistic as possible. We can’t guarantee that the colours look exactly the same as they do on our swatches and images but we try everything we can to make sure they look as close as possible. We do everything we can to ensure that measurements are as accurate as possible however slight variations could occur. Measurements are only approximate and can slightly vary. Sizes are given to us from our suppliers and are displayed by us in good faith. Please measure the area that you are planning on putting the product and any means of access to that area before you place your order. If your measurements suggest that there isn’t going to be another space for the product you should then contact us and we can give you precise measurements before ordering as we can double check the measurements with our supplier. PLEASE NOTE- we cannot refund any products that do not fit into your required space. We reserve the right to withdraw and cancel any offers or sales without any given notice. We make every reasonable effort to ensure that all product descriptions are accurate and as up-to-date as possible. We do however reserve the right to amend, add and remove any products at any time. Please note that all of our products are subject to availability. If an order is placed with us and it isn’t available, we will contact you straight away to let you know about this and give you the option to amend or cancel your order.

10. Cancellation

On all made to order products there is no cancellation policy once payment has been made and the order has been accepted by us. If you wish to cancel an order before making payment then you must inform us in writing at info@milk-interiors.co.uk.

11. Data Protection

We will take all reasonable precautions to ensure that all your order details and payment are secure.

12. Out of stock items

Sometimes items may become temporarily unavailable after you have placed an order for them but if this happens we will inform you straight away and give you two options. You can choose to cancel your order if you would prefer not to wait or we can find out when the product is back in stock and then have it delivered to you immediately when it becomes available again.

13. Ex-display items

Items that are ex-display models are only sold if they have no major defects. They may have small minor defects but we can ensure you that they will have no effect on the usage of the item. We will include any defects in the description of the product on our website. The ex-display models cannot be returned unless the defect wasn’t described.

14. VAT

All prices on our website include a UK sales tax of 20% for VAT. This applies to all UK customers.

15. Right of seller

We reserve the right to periodically update prices on our website, which cannot be guaranteed for any period of time. We will make every effort to ensure prices are correct at the point in which you place an order with us. We reserve the right to withdraw any items from our website at any time. We will not be liable to anyone for withdrawing any items from our website or for refusing to process an order.
